These Terms of Service govern your access to and use of SaySpoke.

By creating an account, accessing SaySpoke, or using any SaySpoke feature, you agree to these Terms and our Privacy Policy and Cookie Policy.

SaySpoke is currently in beta. The product may change, break, pause, lose features, or behave unexpectedly. Use the beta with that understanding.

1. What SaySpoke is

SaySpoke is a social app built around Backing Tags.

Users can:

Post Moments
Share Finds
Create or manage a Finds creator profile
Upload photos or videos
Back posts, profiles, Finds, and other content with tags
Leave Notes, replies, or reactions
Save content
Follow users or Finds creators
Send private messages
Report content or users
Use privacy, account, safety, and trust controls

SaySpoke may change how these features work over time.

2. Eligibility

You must be at least 13 years old to use SaySpoke.

If you are under the age of majority where you live, you may use SaySpoke only with permission from a parent or legal guardian.

You may not use SaySpoke if:

You are legally barred from using the service
We previously removed or banned your account
You are using the service to violate law, harm others, or evade enforcement

3. Beta access and invite codes

SaySpoke may require an invite code during beta.

Invite codes may be limited, expire, stop working, or be revoked at any time. We may limit how many users can join through a code.

Beta access does not guarantee permanent access, future features, compensation, public launch access, creator status, verification, or any special rights.

4. Your account

You are responsible for your account and activity under your account.

You agree to:

Provide accurate account information
Keep your login secure
Not share your password
Not impersonate someone else
Not create accounts to evade blocks, bans, limits, or enforcement
Tell us if you believe your account has been compromised

We may suspend, restrict, or remove accounts that violate these Terms or create risk for SaySpoke or other users.

5. Privacy settings and visibility

You are responsible for checking your privacy and visibility settings before posting or interacting.

Some SaySpoke activity may be public or visible to other users depending on the feature and your settings, including:

Profile information
Moments
Finds
Finds creator profiles
Backing Tags
Notes and replies
Follows
Saves or engagement signals where shown
Public recommendations
Public creator activity

Because SaySpoke is currently new and has a small user base, early users may be more likely to see each other’s content, especially on the Finds side.

Do not post, back, comment on, or share anything unless you are comfortable with the visibility setting attached to that action.

6. User content

You keep ownership of the content you post to SaySpoke.

By posting, uploading, backing, commenting, replying, saving, or otherwise submitting content, you give SaySpoke a worldwide, non-exclusive, royalty-free license to host, store, copy, display, publish, distribute, modify for formatting, process, analyze, moderate, and use that content to operate, improve, promote, and protect SaySpoke.

This license allows us to:

Show your content to other users according to your settings
Display content in feeds, profiles, Finds, discovery, search-like surfaces, or recommendations
Process media for playback, thumbnails, previews, compression, and delivery
Use content for safety, moderation, reporting, appeals, debugging, and abuse prevention
Use public content to explain, market, or demonstrate SaySpoke, unless prohibited by law or your settings
Improve Backing Tags, ranking, discovery, and recommendation systems

You are responsible for the content you submit.

7. Content rules

You may not use SaySpoke to post, upload, share, back, promote, or encourage:

Illegal activity
Harassment, bullying, stalking, or targeted abuse
Threats or incitement of violence
Sexual exploitation or abuse
Content involving minors in a sexual or exploitative way
Hate, dehumanization, or violent extremist content
Impersonation or deceptive identity use
Spam, scams, fraud, phishing, or manipulation
Malware or attempts to compromise the service
Doxxing or sharing private information without permission
Content that violates someone else’s intellectual property rights
Non-consensual intimate content
Graphic violence or gore where not allowed by our rules
Attempts to game Backing Tags, ranking, discovery, saves, views, or recommendations

We may remove content, limit distribution, restrict features, suspend accounts, or take other action if we believe content or activity violates these Terms or creates risk.

8. Backing Tags, Notes, and interactions

Backing Tags are intended to reflect real support, context, recommendation, trust, or appreciation.

You agree not to:

Use Backing Tags to harass, shame, threaten, or manipulate others
Coordinate fake Backings
Sell or buy Backings
Use automation to generate Backings, views, saves, follows, Notes, or other engagement
Misrepresent your relationship to a person, place, creator, business, or Find
Use Notes or replies to spam, abuse, or evade moderation

SaySpoke may rank, limit, remove, hide, or review Backings and Notes to protect the product and users.

9. Finds and creator content

Finds are for recommendations, creator posts, videos, places, resources, and content that may be useful or worth saving.

If you create Finds or a Finds creator profile, you are responsible for:

Having rights to content you upload
Accurately describing what you share
Respecting privacy, intellectual property, and publicity rights
Not misleading users about sponsorships, affiliations, endorsements, or compensation
Following applicable advertising, disclosure, and consumer protection rules

If you receive compensation, free products, affiliate value, or any other benefit connected to a Find, you are responsible for making any legally required disclosure.

10. Private messages

SaySpoke private messages are designed to use client-side encryption for message text. The service may still store encrypted message content, participant records, message metadata, read and delivery status, presence signals, and key information needed to provide the feature.

Do not use private messages for highly sensitive, emergency, financial, medical, legal, or confidential information.

You may not use private messages for spam, threats, harassment, fraud, scams, illegal activity, or evading moderation.

11. Reports, moderation, and safety

SaySpoke may provide reporting, blocking, appeal, and safety tools.

We may review reports and take action based on our judgment, including:

Removing content
Limiting visibility
Restricting features
Suspending or deleting accounts
Preserving records
Contacting users
Reporting to authorities when legally required or appropriate

We are not required to explain every moderation decision.

12. Account deletion and content removal

You may request account deletion through available tools or by contacting us.

Deleting your account or content may not immediately remove all information from:

Backups
Logs
Safety records
Moderation records
Reports or appeals
Other users’ screenshots or copies
Content already shared publicly
Records we must keep for legal, security, or operational reasons

13. Feedback

If you send SaySpoke feedback, ideas, bug reports, suggestions, screenshots, or comments, you allow us to use them without compensation or restriction.

This includes using feedback to improve the product, fix bugs, change features, or build new tools.

14. Third-party services

SaySpoke may use third-party services for hosting, storage, authentication, email, analytics, maps, media processing, security, and other operations.

These services may process information as described in our Privacy Policy and Cookie Policy.

SaySpoke uses Google Analytics to measure site usage and improve the product. Your use of SaySpoke is also subject to our Cookie Policy.

15. Sponsored placements

SaySpoke may display sponsored placements, promotional content, or other paid placements.

Sponsored placements do not mean SaySpoke endorses the advertiser, product, service, or claim.

Users and creators are responsible for making required sponsorship, affiliate, or endorsement disclosures in their own content.

16. Intellectual property

SaySpoke, including its name, design, interface, features, logos, software, systems, Backing Tag structure, and product concepts, is owned by SaySpoke or its licensors.

You may not copy, reverse engineer, scrape, reproduce, sell, or exploit SaySpoke except as allowed by these Terms or with written permission.

17. Prohibited technical activity

You may not:

Access SaySpoke using unauthorized bots, scrapers, crawlers, or automation
Interfere with the service
Probe, scan, or test vulnerabilities without permission
Attempt to bypass security, privacy, invite, rate-limit, or access controls
Reverse engineer private APIs or systems
Upload malicious code
Use SaySpoke to train competing systems without permission
Collect user data without permission
Manipulate views, watch time, saves, follows, Backings, or recommendations

18. No professional advice

SaySpoke content may include recommendations, opinions, places, videos, resources, and user-generated posts.

SaySpoke does not provide legal, medical, financial, safety, professional, or emergency advice. Do not rely on SaySpoke as a substitute for professional judgment or emergency services.

19. Beta disclaimer

SaySpoke is provided in beta and may contain bugs, downtime, data issues, incomplete features, inaccurate recommendations, broken uploads, missing notifications, or other problems.

We may change, pause, limit, reset, remove, or discontinue features at any time.

You use SaySpoke at your own risk.

20. Disclaimers

SaySpoke is provided “as is” and “as available.”

To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, security, and uninterrupted operation.

We do not guarantee that:

SaySpoke will always work
Content will always be available
Discovery or recommendations will be accurate
Uploaded media will always process correctly
Privacy settings will prevent all unwanted viewing
Users will behave honestly
Backings will be accurate or fair
Bugs or security issues will never occur

21. Limitation of liability

To the fullest extent allowed by law, SaySpoke will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, or user conduct.

Our total liability for any claim related to SaySpoke will be limited to the greater of:

The amount you paid SaySpoke in the 12 months before the claim, or
$100

Some jurisdictions do not allow certain limits, so some of these limits may not apply to you.

22. Indemnity

You agree to defend, indemnify, and hold harmless SaySpoke from claims, damages, losses, liabilities, costs, and expenses arising from:

Your use of SaySpoke
Your content
Your violation of these Terms
Your violation of law
Your violation of someone else’s rights
Your misuse of Backing Tags, Finds, Notes, messages, or other features

23. Changes to these Terms

We may update these Terms as SaySpoke changes.

The updated Terms will be posted with a new “Last updated” date. Your continued use of SaySpoke after updated Terms are posted means you accept the updated Terms, unless applicable law requires a different process.

24. Termination

You may stop using SaySpoke at any time.

We may suspend, restrict, or terminate your access at any time if we believe you violated these Terms, created risk, caused harm, or used SaySpoke in a way that could damage the service or other users.

25. Governing law

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules, unless applicable law requires otherwise.
